PRIVACY NOTICE
This Privacy Notice is issued in compliance with the provisions of the Federal Law for the Protection of Personal Data in Possession of Private Parties (hereinafter the Law), published in the Official Journal of the Federation on July 5, 2010, pursuant to articles 8, 15, 16, 17, section II, 33, and 36; its Regulations in articles 14, 24, 26, 27, 28, 30, 30, 40, 41, 42, 68, 90 and 102, and the Privacy Notice Guidelines, in its Tenth, Eighteenth, Twentieth, Twenty-first, Twenty-second, Twenty-third, Twenty-fourth, Twenty-fifth, Twenty-sixth, Twenty-seventh, Twenty-eighth, Twenty-ninth, Thirtieth, Thirty-first, Thirty-second, Thirty-third, Thirty-seventh, and Forty-first and Article 25 of the Regulations of the aforementioned Law.
I. Party Responsible for Personal Data Processing
The Legal Entity “IBEV CASA TEQUILERA, S.A. DE C.V.”, dedicated to the activity outlined in its corporate purpose, stating the making, production, manufacture, distribution, export, import and trade in general of all types of alcoholic beverages, distilled or otherwise, mainly tequila, notwithstanding any other alcoholic beverage whether or not it is subject to rules of denomination of origin, collective brands or any other specific regulation, among other activities that make up the corporate purpose, is hereby declared to be legally constituted according to Mexican law, pursuant to Public Instrument Policy number 964, First Registry Book, dated January 15, 2016, before the Holder of the Public Brokerage Office number 44 of Jalisco, Atty. Luis Fernando Mayorquin Velez, which was duly registered before the Public Registry of Property and Commerce of the State of Jalisco, by means of the Registration Ballot with Electronic Commercial Folio number 95349*1, of internal control 53 dated April 06, 2016, ballot by which the constitution of the commercial entity described above was legally registered, with RFC ICT160115SG6, REGISTRO PATRONAL B7811196106, located in Royal Country exterior number 4650-2002, 20th Floor, Interior S, colonia Puerta de Hierro, Zapopan, Jalisco, C. P. 45116, and/or at the establishment located at Camino a la Barranca del Tecuane number 18, Ejidal, Amatitan Jalisco, C.P. 45380, Represented in this Act by Single General Administrator Mr. HUGO YERENAS DOMINGUEZ.
The personal data to be processed consists of personal information of both the legal entity and its legal representatives, which may include: your name and/or full name, e-mail address, address, telephone numbers, place and date of birth, marital status, number of children, health status, education, professional experience, personal and professional references, socioeconomic status, financial and property data, bank accounts, social security number, Federal Taxpayer’s Registry Number (RF), Personal Population Registry Code (CURP), among other strictly indispensable information for the purposes mentioned below. If we do not have your personal data, we would not be able to carry out the purposes for which they are required, which would forfeit our liability arising from said purposes.
II. Purposes of Personal Data Processing
Your personal data will be collected without the purpose of disclosure or commercial use, and will be used solely for the following purposes:
• To make quotations of goods and services from customers and suppliers;
• To make national and international commercial, civil, and labor contracts;
• Recruitment of personnel for job openings;
• Compliance with legal, tax, labor, social security, and other obligations, arising from the employment relationship and other legal relationships with third parties;
• Potential management or legal processes involving the holder of the personal data;
• To be transferred to various labor exchanges for recruitment purposes only and exclusively, authorizing to be informed of such information and notifications regarding future vacancies;
• To develop work projects;
• To record audio and video;
• To take photographs;
• For all types of presentations, both physical and digital;
• Banking accounts, financial statements, results statements;
• To generate optical and/or audio files;
• To generate work groups
• To develop formulas, recipes, programs, strategies; and
• Marketing campaigns, both physical and digital, or any type.
Personal data will be kept under the strictest confidentiality and may not be used for any purpose other than those mentioned above, unless there is a change in this Privacy Notice.
Once the purpose of the processing of personal data is fulfilled, such data will be blocked for the sole purpose of determining possible liabilities in relation to their processing, until the legal or contractual limitation period of such liabilities. During such period, personal data could not be processed, after which it will be deleted from the corresponding database.
Nevertheless, the personal data of candidates who have not been found viable to fill the vacancy for which they applied, will be immediately deleted and will not be retained in any company database.
III. Personal Data Collection
For personal data collection, we follow all the principles established by law, such as legality, quality, consent, information, purpose, loyalty, proportionality, and responsibility.
Personal data will be collected directly from the holder in person or through other optical, audio, visual means, or by any other legally permitted technology, either through applications, resumes, interviews, socio-economic studies, medical and psychometric evaluations, on our website, social networks, websites or online services, among others,
The information we receive and store from our webpages when you interact with our website is mainly technical information, such as your Internet Protocol address, your computer operating system and browser type, the address of a referring website, if any, and the path you take as you navigate through our website. We use “cookies” to recognize you when you use or return to our sites. A “cookie” is a small text file that a website or e-mail can save on your browser and store on your hard drive. You can choose to navigate in our websites without allowing cookies. Cookies allow us to recognize you from page to page, and support your transactions with us. Without cookies enabled, you will be able to browse our websites, but you may not be able to use some features of the website. This information is collected to enable the websites to operate properly, to evaluate website usage and to support promotional campaigns.
Furthermore, we may obtain information about the holder from other sources permitted by law, such as telephone or labor directories, job boards, references from other companies or individuals, public databases of any public or private entity or agency, among others.
IV. Options and means to limit the use or disclosure of data;
The company has the necessary and sufficient security, administrative, technical, and physical measures to protect your personal data against damage, loss, alteration, destruction, use, access, or unauthorized processing.
Personal data are safeguarded in databases and computer equipment that have the necessary security to prevent information leaks. Physical and logical access controls, environmental controls, anti-intrusion protection systems (IPS, Firewall), antivirus protection tools and web filtering are some of the tools used to maintain data security in the information systems.
The IT security tools mentioned in the previous paragraph are supported by an internal information security policy that consists of explaining to employees the security considerations they must take into account when using an IT system, an aspect which is constantly reinforced.
Therefore, we hereby inform you of the options you have to request the limitation of the use or disclosure of your personal data, subject of this Notice:
a) To notify in writing the Person Responsible for the Processing of Personal Data (at the address indicated in point VI below); or via email to the address hugo@casatequilera.com.
